These Terms and Conditions ("Terms") govern the use of the Arabelle Yee International website (www.arabelleyee.com) operated by Lumos Global LLC, Dubai, UAE ("Company", "We", "Us"). By accessing this website, enrolling in our programs, or attending events, you agree to be bound by these Terms. Please read them carefully.

1. Definitions

You acknowledge that participation in programs, events, or services offered by Arabelle Yee International (AYI) may involve various areas of your life, such as work, finances, health, relationships, education, and recreation. You agree that deciding how to incorporate the principles you learn and implementing changes is solely your responsibility.

You are responsible for creating and managing your physical, mental, and emotional well-being, decisions, and actions arising from working with AYI through both online and offline events, programs, retreats, and services. AYI will not be liable for any actions or inactions or any direct or indirect result of services provided. AYI does not diagnose, prevent, treat, or cure any mental disorders or medical diseases.

Any services provided by AYI are not intended to replace medical or psychological treatments. You are responsible for seeking independent professional advice where necessary. If you are under the care of a mental health professional, it is recommended that you inform your provider about your work with AYI.

2. Client - AYI Relationship  

Working with AYI may involve multiple areas of your life. The decisions you make and how you incorporate what you learn from AYI into your life are your sole responsibility.

AYI does not offer medical, psychological, legal, or financial advice. Our services do not substitute for professional advice from qualified professionals. You are responsible for seeking independent guidance from these professionals when necessary.

3. Fees and Cancellations

By enrolling in any programs, events, or retreats offered by AYI, you agree to pay the fees stated at the time of enrollment, as communicated through marketing materials. All payments are non-refundable.

Transfers of payment are considered at AYI’s sole discretion and may be allowed only in cases of medical or life emergencies. Clients may transfer their payment to another person if AYI determines that the new participant is a good fit for the program, retreat, or event. AYI reserves the right to approve or deny transfers based on suitability.

Installment payments, if agreed upon, must be completed by the agreed-upon date. 

Coupon codes must be entered correctly at checkout and cannot be applied retroactively once payment is processed. Coupons may have specific conditions, including expiration dates. Ensuring the use and correct application of any available coupon code is entirely your responsibility. 

4. Program Access Duration 

Effective January 2024, all programs are available for a one-year duration from the date of purchase, unless otherwise communicated. Exceptions may be granted at the discretion of AYI on a case-by-case basis and communicated directly to the client.

5. Limited Liability 

AYI makes no guarantees or warranties regarding any retreats, events, programs, or services. In no event shall AYI be held liable for any indirect, consequential, or special damages resulting from your participation.

AYI will not be responsible for any personal injury, accidents, illness, loss, or damage to personal property during retreats, events, or other activities provided by AYI. The maximum liability of AYI is limited to the amount paid by the client for the specific retreat, course, or program in question.

6. Entire Agreement  

This agreement represents the complete understanding between AYI and the client regarding the subject matter and supersedes all prior agreements. No amendments can be made without mutual consent.

7. Severability   

If any provision of this Agreement is found to be unenforceable, the remaining provisions will continue in full effect. The unenforceable provision will be deemed modified to the extent necessary to make it enforceable. 

8. Waiver 

The failure of either party to enforce any provision of this Agreement shall not be considered a waiver of that party’s right to enforce the provision later.

9. Dispute Resolution 

In the event of a dispute arising from this agreement, both parties agree to attempt mediation in good faith for 30 days. If the dispute cannot be resolved, it will be governed by the laws of the United Arab Emirates (UAE) and resolved through the courts of Dubai. Arbitration may also be pursued under UAE regulations.

10. Governing Law 

This Agreement is governed by the laws of the United Arab Emirates without regard to its conflict of law principles. Disputes shall be resolved exclusively in Dubai courts.

11. Personal Health, Medical Advice and Personal Responsibility

AYI does not prescribe medications or advise clients to stop taking any medications prescribed by their doctors. Our programs, retreats, or events promote emotional, mental, and physical well-being but do not replace professional medical or psychological advice. You are solely responsible for managing your health.

By enrolling in AYI programs or events, you confirm that you are physically, mentally, and emotionally fit to participate. AYI is not responsible for any health-related issues arising during participation. It is recommended that you consult with a healthcare provider before attending events or retreats.

12. Intellectual Property (IP)

All content provided by AYI, including courses, videos, texts, images, and other materials, is protected by intellectual property laws. Content created by clients during AYI programs, events, or retreats becomes the sole property of AYI, which reserves the right to use this content for promotional or educational purposes.

Clients may access AYI content solely for personal learning. Unauthorized use or reproduction of AYI’s intellectual property is prohibited, and AYI reserves the right to take legal action.

13. Event Booking Policy

To secure your place in an event or retreat, full payment must be made by the deadline. If the event date is less than 30 days away, full payment is required at booking. If payment is not received by the due date, AYI reserves the right to cancel your reservation and retain the deposit.

If you leave a retreat before its conclusion, no refunds will be provided. Travel insurance is highly recommended.

14. Cancellation Policy

All payments made are non-refundable. However, they may be transferable to another event or program at AYI’s discretion. If AYI cancels or reschedules an event, you may transfer your full payment to another retreat or program within 12 months. AYI will not cover expenses such as airfare or accommodation.

15. Fitness to Participate Clause

Participation in AYI programs or events may require a certain level of physical, mental, or emotional fitness. By enrolling, you acknowledge that you are capable of participating and have consulted with your healthcare provider where necessary.

16. Force Majeure

AYI is not liable for failure to perform due to events beyond its control, including but not limited to natural disasters, wars, government actions, or pandemics. In such cases, AYI will refund only the portion of payments that has not been used for bookings or expenses. Administrative fees may be deducted from the refund.

17. Media Release

By attending events or retreats, you consent to being recorded or photographed. AYI reserves the right to use these recordings for promotional purposes. If you do not wish to be included, you must notify concierge@arabelleyee.com before the event begins.

18. Age Restriction

Participants must be 18 years or older to enroll in any AYI programs, events, or retreats.

19. Currency and Payment Terms

All payments are processed in US dollars (USD). Clients are responsible for any currency conversion fees or fluctuations.

20. Early Termination of Program Access

AYI reserves the right to terminate access to any program or event if it is found that a client is in violation of these Terms. No refunds will be provided in the case of early termination due to violations.

21. Automatic Payment Renewals

For subscription or membership payments processed via Stripe, payments will be charged automatically according to the agreed frequency (e.g., monthly or annually). If you cancel your membership, you will retain access for the remainder of the billing cycle, but no refunds will be issued.

22. Data Use and Protection

AYI is committed to protecting your personal data. For details on how we handle your data, please refer to our Privacy Policy. AYI complies with GDPR regulations for users in the European Union.

23. Right to Amend Terms

AYI reserves the right to modify these Terms & Conditions at any time. Any changes will be communicated via email or posted on our website. Continued use of our services after changes have been made indicates acceptance of the updated Terms.

24. Acknowledgment

By purchasing, enrolling in, or attending our programs and events, you agree to these Terms and Conditions. This agreement is effective and binding, even if it is electronic and not physically signed by you.
