These Terms and Conditions ("Terms") govern your use of the products, services, programs, and digital platforms offered by Lumos Global L.L.C-FZ, a company registered in Dubai, UAE ("Company", "We", "Us", “Our” , “Lumos Global”), operating under the trade name “Arabelle Yee” or “Arabelle Yee International”. Our offerings are accessible through www.arabelleyee.com, www.lumosglobal.biz, and other websites, portals, and applications we may use or share from time to time (collectively, the “Platforms”). By accessing our Platforms, enrolling in our programs, or attending our events, you agree to be bound by these Terms. Please read them carefully.

1. Definitions

You acknowledge that participation in programs, events, or services offered by Lumos Global (operating as Arabelle Yee) may involve various areas of your life, such as work, finances, health, relationships, education, and recreation. You agree that how you choose to incorporate the principles learned and any resulting changes are solely your responsibility.

You are solely responsible for your physical, mental, and emotional well-being, decisions, and actions arising from working with us through online or offline offerings. We are not liable for any actions, inactions, or consequences related to our services. We do not diagnose, prevent, treat, or cure any mental or physical conditions.

Our services are not intended to replace medical or psychological care. You are responsible for seeking independent professional advice when necessary. If you are under the care of a mental health provider, we recommend informing them of your participation in our offerings.

2. Client – Company Relationship

Your experience with us may impact various aspects of your life. The decisions you make and how you apply what you learn are your sole responsibility.

We do not provide legal, financial, medical, or psychological advice. Our services are not a substitute for professional advice, and you should consult qualified professionals when necessary.

3. Fees and Cancellations

By enrolling in our programs, events, or retreats, you agree to the stated fees at the time of registration. All payments are non-refundable.

Payment transfers are considered at the Company’s discretion and may only be allowed in medical or life emergencies. Clients may request to transfer payment to another person, subject to Company approval and suitability assessment.

If installment payments are agreed upon, they must be completed by the specified due date.

Coupon codes must be applied at checkout and cannot be retroactively added. Ensuring accurate use of any codes is your responsibility.

4. Program Access Duration

Effective January 2024, program access is valid for one year from the purchase date unless otherwise stated. Exceptions may be made on a case-by-case basis at the Company’s discretion.

5. Limited Liability

We make no guarantees or warranties regarding any of our offerings. In no event shall Lumos Global be liable for indirect, consequential, or special damages.

We are not responsible for personal injury, illness, accidents, or property loss during our events. In any case, our total liability to you shall not exceed the amount you paid for the specific program or event.

Nothing in these Terms excludes liability for fraud, gross negligence, or willful misconduct.

6. Entire Agreement

This document constitutes the entire agreement between you and Lumos Global. It supersedes any prior agreements and may only be amended with mutual consent.

7. Severability

If any part of this agreement is found unenforceable, the rest remains effective. The unenforceable portion will be modified to make it valid and enforceable.

8. Waiver

Failure to enforce any part of this agreement does not waive the right to enforce it later.

9. Dispute Resolution

In case of a dispute, both parties agree to attempt mediation for 30 days. If unresolved, disputes will be governed by UAE law and resolved in Dubai courts. Arbitration may also be pursued per UAE regulations.

10. Governing Law

This agreement is governed by the laws of the United Arab Emirates. All legal proceedings will be conducted in Dubai, UAE.

11. Health & Personal Responsibility

We do not prescribe or advise on medication. Our offerings promote well-being but do not replace professional healthcare. You are responsible for managing your health and should consult your healthcare provider before participating.

12. Intellectual Property

Any content created by clients during our offerings remains the property of the client; however, by participating, you grant Lumos Global a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content (including testimonials, images, or recordings) for promotional or educational purposes.

You may use our content for personal learning only. Unauthorized use or distribution is prohibited and may result in legal action.

13. Event Booking Policy

To confirm your spot at any event or retreat, full payment is required. If the event is within 30 days, payment is due at booking. Non-payment may result in cancellation and loss of deposit.

No refunds are issued for early departure from a retreat. Travel insurance is highly recommended.

14. Cancellation Policy

All payments are non-refundable but may be transferred to another program/event at our discretion. If an event is canceled or rescheduled, payment can be credited toward another offering within 12 months. We are not liable for related travel or accommodation expenses.

15. Fitness to Participate

You acknowledge that you are physically, mentally, and emotionally fit to participate. You are responsible for consulting with your healthcare provider if necessary.

16. Force Majeure

We are not liable for non-performance due to events beyond our control, including but not limited to natural disasters, government actions, or pandemics. Refunds, if any, will exclude any non-recoverable expenses and may include administrative deductions.

17. Media Release

By attending our events, you consent to being photographed or recorded. We may use these for promotional purposes.

If you prefer not to be photographed or recorded, please notify us in writing at [email protected] before the event, and we will make reasonable efforts to accommodate your request.

18. Age Restriction

You must be 18 years or older to attend or enroll in any of our offerings.

19. Currency and Payment Terms

All fees are processed in USD. You are responsible for any currency conversion fees or fluctuations.

20. Early Termination of Access

We reserve the right to terminate access to any offering if these Terms are violated. No refunds will be provided in such cases.

21. Automatic Payment Renewals

For subscription-based services, payments will renew automatically via Stripe. Cancellation will stop future charges, but no refunds are issued for the current billing cycle.

22. Data Use and Protection

We respect your privacy. Please refer to our Privacy Policy for how your data is handled.

We comply with applicable data protection laws, including the UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data and the EU General Data Protection Regulation (GDPR) for EU users.

23. Mobile App License Agreement (EULA)

By downloading or using the Arabelle Yee mobile application (the “App”), you agree to the terms of this Mobile App License Agreement, which forms part of and is governed by these Terms and Conditions.

License Grant

Lumos Global grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App solely for your personal, non-commercial use, in accordance with these Terms and any applicable app store rules.

Restrictions

You agree not to:

  • Copy, modify, distribute, sell, or lease any part of the App.

  • Reverse engineer or attempt to extract the source code.

  • Use the App in a way that interferes with or disrupts the services provided by Lumos Global or its partners.

Ownership and Intellectual Property

All rights, title, and interest in and to the App and its content (including text, graphics, software, data, and materials) are owned by Lumos Global or its licensors. This Agreement does not grant you any ownership rights in the App.

Updates and Availability

We may release updates, bug fixes, or new versions of the App at any time. Continued use of the App after such updates constitutes acceptance of the revised version.

Data and Privacy

Use of the App may involve the collection and processing of personal data as described in our Privacy Policy, available at https://arabelleyee.com/privacypolicy.

Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if the App becomes discontinued.

Disclaimer

The App is provided “as is” and “as available” without warranties of any kind. Lumos Global disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Lumos Global shall not be liable for any damages arising out of or related to your use or inability to use the App.

Third-Party Terms

The App may rely on third-party services, including Apple Inc. and Google LLC, whose own terms and policies also apply to your use of their platforms.

24. Right to Amend Terms

We may update these Terms at any time. Changes will be communicated via email or posted online. Continued participation indicates your acceptance of the revised Terms.

25. Acknowledgment

By purchasing, enrolling in, or attending our programs or events, you agree to these Terms. This agreement is binding even if not physically signed.
